Representative matters include:
Successfully represented the New York State Department of Health in lawsuits challenging the closure of several healthcare facilities. Community Coalition v. Mount Sinai & DOH; De Blasio v. SUNY & DOH; Berger v. Prospect Park Residence & DOH.
Represented New York State Liquidation Bureau in successful effort to recover from the federal government $575 million in Affordable Care Act Risk Corridors and Reinsurance payment obligations on behalf of creditors of Health Republic Insurance of New York.
Represent former employees of national Medicare Advantage Organization defending against federal False Claims Act lawsuit.
Won dismissal of all claims against former Governor Andrew Cuomo in litigation concerning the constitutionality of one-week curfew imposed in New York City in June 2020.
Helped implement and monitor federal consent decree between the U.S. Attorney’s Office for the Southern District of New York, the New York Attorney General’s Office, and one of the largest landlords in New York City, requiring landlord and related entities to remediate substandard housing conditions across more than 2,500 apartments.
Represented an apparel importer in the defense and settlement of a federal false claims action alleging the underpayment of customs duties.
Represented employees of a federally funded job placement center accused of defrauding the government by misrepresenting the number of successful job placements achieved.
Represented the New York State Department of Environmental Conservation, and the Office of the State Comptroller, in high-profile lawsuits relating to regulatory and constitutional challenges and government enforcement disputes.
