Served as conflict counsel for debtors in the bankruptcy of Cumulus Media Inc. and its affiliates, conducting document discovery and taking depositions in response to challenges to bankruptcy plan confirmation brought by the Unsecured Creditors Committee.
Obtained voluntary dismissal of a $1 million clawback claim against European client after extensive negotiations with counsel for the litigation trust concerning the trust’s wrong payor theory of liability and extraterritorial application of claw-back provisions.
Obtained preliminary relief on behalf of former employees targeted by Rule 2004 subpoenas seeking information relating to alleged improprieties by a debtor’s former executives.
Won dismissal of all claims against the former independent directors of an Israeli-American holding company forced into bankruptcy following the failure of its investment in an Egyptian natural gas pipeline; favorably settled related clawback actions.
Secured a favorable settlement for the brother of Bernie Madoff’s accountant in defending a clawback action in the Madoff bankruptcy.
